Alternative Dispute Resolution-We strongly urge our clients that wish to retain control over the terms of their divorces to consider Alternative Dispute Resolution (ADR). ADR allows a client to resolve their legal conflicts without going to trial. With our extensive expertise we are able to determine which cases are best resolved in an ADR forum. Our firm has been in the forefront of this area and has found clients to be more satisfied with the results of a mediation that they participated in more than they are with decrees determined out of their presence by judges and attorneys. Our firm encourages resolution of family law disputes via mediation or other out of court means. Often, the results obtained in this fashion are better or equal too what may be obtained in contested litigation. Mediation offers a private setting for resolution of a case, allows the client to retain control of their case and is often less costly than litigation. Furthermore, our experience has shown that results obtained via mediation are less subject to future actions for enforcement as people tend to comply with agreements that they feel they have a voice in making, as opposed to a court order. Mediation also provides a mechanism to resolve disputes for which our courts do not recognize rights, such as disputes between same sex partners, grand parent visitation rights and custody claims where there is no legal right to assert, such as the "psychological parent" situation.
